Here’s an odd wrinkle in the ongoing Taylor Swift vs. Kim Kardashian and Kanye West saga: According to TMZ, Swift can’t sue the couple for secretly recording her phone conversation to discuss Kanye’s “Famous” lyrics because the call was put on speaker.

While California law states that it’s a felony to record a “confidential communication” without the person on the other end knowing about it, that doesn’t include conversations that “may be overheard.” Because Kanye was clearly on speaker while talking to Swift–with producer Rick Rubin often heard piping up in the background–Swift’s got no legal ground to stand on. Still, her lawyers reportedly sent a letter in February threatening to press charges and push for criminal prosecution against him for secretly recording the call

Selena Gomez tried to defend BFF Taylor Swift in her fight against Kim Kardashian and Kanye West on Twitter yesterday, but wound up insulting Black Lives Matter activists in the process. “There are more important things to talk about,” Selena initially tweeted about the controversy surrounding Kanye’s “Famous” lyric. “Why can’t people use their voice for something that ******* matters?” After one follower replied, “Good question! Why haven’t you or Taylor not said a thing about #BlackLivesMatter?” Gomez replied, “So that means if I hashtag something I save lives? No–I could give two ****s about ‘sides.'” That remark prompted a “#SelenaIsOverParty” hashtag, and comments like “Selena act like she actually use her voice when all she do is whisper into a turned-off microphone.”
